Proceedings have begun in Georgia concerning the multimillion-dollar inheritance of the former director-general and co-owner of the Ural Works of Civil Aviation, Anatoly Paderov, who left Russia almost 20 years ago while he was prosecuted by the Federal Security Service. Georgian prosecutors have already engaged in addressing the issue, and the Ural heirs themselves have initiated large-scale search for assets around the world.

"Our Georgian lawyers have also revealed some other inheritance thefts, including in other countries. These have not yet been announced for purposes of the investigation", said Alexander Strepetov, a managing partner of the «Ucom» law firm.

Against the backdrop of sanctions and the curtailment of interbank activity between countries, there is a growing demand for cryptocurrencies in Russia. "Judicial practice regarding cryptocurrency is now very contradictory. Courts do not always know how to evaluate cryptocurrency. For example, if the deal in our dispute was concluded after any country had recognized cryptocurrency as a currency (in September 2021, Bitcoin was approved as legal tender by the Republic of El Salvador. – τ.), then perhaps the court of first instance would have decided differently", said Alexander Strepetov, a managing partner of the «Ucom» law firm.

Over the past six months, the Ural commercial courts have recorded an increase in the number of administrative proceedings between entrepreneurs and the state structures. In the Sverdlovsk region alone, such claims increased by 81.2 per cent in June, and in the regions, they increased by 35 percent over six months. Market participants complain about increased administrative pressure, and experts, including lawyers, attribute the current trend to the strengthening the fight of fiscal and oversight authorities against quasi-legal work schemes.

According to Alexander Strepetov, the Federal Tax Service is now actively tackling the shadow economy. This also influences growth in the number of administrative disputes.
"The oversight in this field is strengthening, as seen even in the black market. While a few years ago the average cash withdrawal fee was 2–3 per cent, now it can reach 12–15 per cent in Yekaterinburg, and up to 20 per cent in Moscow", said the expert.
According to him, while fighting against cash withdrawal, tax authorities began to closely monitor the companies’ registered seats.

To address the challenge, it is proposed to demolish the section or to remove the balconies.
"The court of cassation stated that the court of first instance used a formal approach to assess the completeness of the expert’s opinion", said our interlocutor.
According to him, today the courts usually rule in favor of developers in such disputes. This is because judges often take into account possible violations of the shareholders rights. When considering the claim against the Brusnika company, the courts pointed out that if the wall of the high-rise building was reconstructed and the windows and balconies were removed, this would violate the rights of the residents.
